Sale of Cemetery Lots & Setting Bounds

ORDINANCE RELATING TO SALE OF CEMETERY LOTS AND SETTING BOUNDS THEREIN, IN TOWN OF BRADFORD CEMETERIES

The Town of Bradford, by its duly elected Selectmen and pursuant to RSA 41:8 and RSA 31:39 order and ordain that, effective as of February 1, 1988:

1.         The price per lot whenever new lots are sold shall be not less than Five Hundred ($500.00) Dollars.

2.         Within ninety (90) days of receipt of request by the superintendent of cemeteries, the owners of all cemetery lots in the Town cemetery shall install permanent stone corner markers, flush with the ground so that mowing is not interfered with.

3.         The superintendent of Cemeteries shall designate what stone markers are appropriate, and if the owners request, will supply and install the corner markers, at the expense of the owner(s), Which shall be paid in advance, and consist of the lay-down cost to the Town of the markers plus a Twenty-five Dollars ($25.00) installation fee.

4.         These prices and fees may be amended on order of the Selectmen, after public hearing.

Pursuant to the authority invested in the Selectmen of the Town of Bradford under New Hampshire Revised Statutes Annotated 31:39 (Towns may by-law for care, protection, preservation and use of public cemeteries etc., the following ordinance is hereby enacted for the protection of the property within the Town of Bradford.)

The following regulations shall apply in all towns owned cemetery:

1.         No person except cemetery or police officers shall be within the cemetery except during daylight hours The Selectmen of the Town and the cemetery superintendent are also excluded from these regulations.

2.         No vehicles shall be driven through the cemetery except roads designated for that purpose and no vehicles shall be driven faster than fifteen (15) miles per hour on said roads.

3.         No person shall allow any dog to run at large.

4.         Cemetery Superintendent shall maintain order and shall eject any person whose conduct is objectionable or who violates this ordinance.

5.         No person shall discharge firearm or any other weapon including but not necessarily limited to bows and arrow, in or adjacent to any cemetery. This prohibition shall not apply to authorized volleys at burial services.

6.         No person shall fault or neglect by allowing any stock to trespass upon any public burial place or private graveyard protected by fencing.

7.         No person shall use cemeteries as picnic grounds, or consume alcoholic beverages in a cemetery, or bring same upon the premises.

8.         No person shall deposit rubbish or debris on cemetery grounds, except in receptacles as provided, if any.

9.         No persons shall injure or deface any monument, stone, fence or other structure, or property within the cemetery.

As prescribed in RSA 31:39, violation of this ordinance shall result in a penalty not exceeding one hundred dollars ($100.00) for each offense.
