Zoning Board Meeting Minutes 01/17/18

Meeting was called to order @ 7:02pm

Board members present: Bill Duffy, Brooks McCandlish, Nathanial Bruss, and Denise Renk

Bob Hodges, alternate, sat in for Steve Pierce who was absent

First item on the agenda: Dunne application for subdivision

Notices for this meeting were mailed January 4th, one abutter had just received the notice today

Applicant was asked to state their request, the Dunnes had Attorney Sean M Dunne, of Law offices of Shawn J Sullivan, PLLC read their application and stated that this request is for a line on the tax map, resulting in 2 tax cards, for the 2 homes on Bible Hill Road, Bradford, NH.

Questions from the Board:

  • What year was the house built? 2002

Brooks read the 2002 special exception approval for this property approving 2 homes on the lot

Questions were asked of the public meeting:

Brackett Scheffy noted how well maintained this class VI road is and gave his opinion that this will not change anything other than the tax map. He also suggested that the RSA 674:41,I C be filed with the state. This RSA states the town will not be liable for maintenance of the road, including any damages resulting from road use, including police, fire, ambulance, and school bus transportation.

Carolyn Stiles, an abutter, read the definition of a variance and questioned if a variance could have a variance. Ms Stiles also mentioned past/present issues with the road due to the Dunne maintenance. Dirt and stones were never cleared from one of her stone walls and some vegetation may not return due to some road work. It appears these items have been an issue for some time and no resolution has been reached. When asked, Ms Stiles did not object to the subdivision.

Brooks read the Conservation letter dated 01/02/18

The letter reinforces the issues of 2 homes on 1 property, and recommends it not be a practice in the future.

Public meeting was closed, and the board discussed the request.

The board went through the 5 criteria to approve a variance

It was not opposed to public interest

For a variance to be granted the spirit needs to be met

This will help the neighborhood by having conforming lots with 1 house per lot for comps in the future

By granting the variance we would not be opening up any development in the future

The board discussed if there was a simple solution to the erosion and clean up need for the abutter? No simple solution was evident, though Mr Tom Dunne did say he would work with Ms Stiles by giving her notice when he would clean up the rock wall so she could be present when he was on her property.

A motion made by Nathanial Bruss:

I motion that the zoning board approve the application with a condition that the record of notice, RSA 674:41, be sent to the registry of Deeds with the information specified covering both lots.

Bill Duffy seconded the motion

The board voted, 5-0 request was granted
