ZONING BOARD MINUTES

June 3rd, 2020

7:00 PM HELD REMOTELY VIA ZOOM PLATFORM

Members: Brooks McCandlish, Chair; Ken Parys, Vice Chair; Beth Downs, Denise Renk, Nathaniel Bruss (in attendance at 7:15pm)

Alternates: Robert Hodges (Absent), William Duffy (Absent)

Members of the public: David English, Dan Higginson, Liz Nolan Esq, Julie Carignan, David & Cindy Nunnally.

Meeting was called to order at 7:02pm

To Do:

  • Review and consideration of May 6th, 2020 minutes.

Appearances:

  • Elizabeth J. Nolan Esq. with builder Dan Higginson. Elizabeth J. Nolan Esq. representing the applicant David A. and Julie Carignan for a Variance to Article III, Section DI, IV and V of the Bradford Zoning Ordinance. On such property located at 244 Breezy Hill Road, Tax Map 18 Lot 13, the applicant proposes to tear down existing dwelling and replace with a two-bedroom dwelling on/ and or about the location of the existing dwelling.

Public hearing began at 7:07pm

Elizabeth J.  Nolan read variance application into record.  The applicant seeking a height variance because of topography. From thirty-five feet to forty feet. Brooks McCandlish head Chair questioned what the height from the basement to the peak will be? The builder Dan Higginson clarified that the basement was eight feet from the first floor and from the first floor the height was thirty-six feet to the peak of the home. With this information being clarified the Chair stated that height does not need to be considered.

             Elizabeth J. Nolan Esq. stated that the applicant was seeking variance to construct the property closer to the road than the current ordinance allows with the argument that the property would be no closer than any of the other homes.

Denise Renk expressed concern of snow accruement near the road in the winter, Builder Dan Higginson explained that there would be fifteen feet of pavement and six feet from the right of way. Nathanial Bruss asked what the dimensions of the foot print for the new building would be? Dan Higginson stated 36x 38ft in depth includes garage.

Abutters David & Cindy Nunnally were in attendance and in favor of accepting the variance.

8:03 pm public hearing closed.

 The Zoning Board deliberated on the variance application and agreed that all five criteria had been met.

 Brooks McCandlish informed the applicant that a notice of decision will be sent. The public has thirty days for an appeal. The applicant may begin at own risk.

  • David English for a preliminary variance discussion Map 10 Lot 9

 The property consists of eighty-four acres with 575 feet of road frontage on Forest Street and Jewett road has 49 ½ feet of road frontage. The property owner would like to divide the property into three lots. Two of the lots would be located on Forest Street and one located on Jewett Road. Both streets are on seasonal class five roads. The Zoning Board informed Mr. English that he would need to apply for a variance for Jewett Road.

Article 5 zoning ordinance discussion

The Zoning Board Discussed reaching out to the Planning Board in regards to what the vision for the town is around the lake and the lack of specific guidelines around Lake Massasecum. No decisions were made.
