Licensing of Bagette and Similar Automatic Amusement Devices

ORDINANCE REGULATING LICENSING OF BAGETTE AND SIMILAR AUTOMATIC AMUSEMENT DEVICES

SECTION I: This article is for the purpose of raising revenue for the regulation and control of automatic amusement games which include video, pinball, arcade and any other coin operated machines.

SECTION II: Pursuant to the authority invested in the Selectmen of the Town ofBradfordunder New Hampshire Revised Statutes Annotated, Chapters 31; 41d and 47:17, the following ordinance shall be in effect unless rescinded.

SECTION III: Automatic amusement games, as described above in Section 1, operated, maintained or used in any public or quasi-public place or building, store or other place wherein the public is invited or wherein the public may enter and particularly but not by way of limitation, all coin operated automatic amusement devised of this type maintained or used as aforesaid shall be licensed by the Town of Bradford after the approval of same by the Board of Selectmen and shall not be placed, maintained or used within the town until such approval is given.

SECTION IV: A separate application for the license required by this article for each machine shall be filed on a form to be furnished by the Town of Bradford, which form shall show the name, residence and post office address of the applicant, and whether or not the applicant has been convicted of a crime, or any violation of the New Hampshire Criminal Code RSA Title LXII.

SECTION V: The fee for the issuance of a license required by this article shall be $’25.00 for each machine so licensed. The license placing, operator maintenance or use of amusement devices or machines mentioned in Section 1, shall be issued for the fiscal year, commencing July first and expiring June thirtieth at midnight.

SECTION VI: No device or machine regulated by this article shall be placed, operated, maintained or used in any place prescribed by this article unless there shall be affixed thereto, in a conspicuous place so that the same shall be easily and quickly identified, the license issued by the Town of Bradford for the operation thereof.

SECTION VII: No license shall be issued under this article to any person who has been convicted of a crime.

SECTION VIII: No such machine or device coming within the purview of this article shall be licensed, used, placed, maintained or operated in any location within three hundred yards of any school.

SECTION IX: Any person who shall permit a minor under the age of sixteen years to play or operated any machine or device licensed under this article after 7:00 PM shall be deemed to be guilty of a violation of this article and punished as provided by this code.

SECTION X: Hours of operation relative to this article shall be limited from 9:00 AM to 11:00 PM.

SECTION XI: Any violation of this ordinance shall be subject to a fine of $100.00 on the first offense, and $100.00 on any subsequent offenses and violation shall be subject to revocation of licenses.
