Review minutes of 7/5/2023 minutes   

Motion: Nathanial Bruss made a motion to accept the minutes from the July 5, 2023 meeting as written

Second: Laura Beaton

Decision: All present agreed, 5-0 in favor

New Business

Application Received:

Ashley Miller – Special Exception for Commercial Use in Residential Rural District – Map 11, Lot 58 – 3087 State Route 114

Ashley Miller in attendance:

Ashley asked questions about public hearings: Why was there one for permitting and one for special exception? In the original Planning Board application, the zoning of the property was erroneously represented on the property card as “Residential/Business.” In fact, the property lies in a residential zone.

Brooks asked if this application was needed or if the property could be grandfathered. When consulting the ordinance, it was found that the buildings needed to be in use within two years of the zoning ordinance, 1989. Ashley estimated that the buildings were not in use within two years of the zoning ordinance so the property is not grandfathered and the special exception is required.

Nathanial asked the Board if this development is of regional significance. Board agreed that this development would not have regional impact.

Motion: Nathanial Bruss moved that the Board agree that this special exception application has no regional impact

Second: Bill Duffy

Decision: All present agreed, 5-0 in favor

Schedule a hearing: A special meeting for the hearing of this application is scheduled for Wednesday, 7/16 at 7:00 pm at the Bradford Area Community Center.

Motion: Brooks McCandlish moved that the Board meet in special session on Wednesday, August 16, 2023 at 7:00 pm at the Bradford Area Community Center for the purpose of a public hearing for this application.

Second: Jim Varney

Decision: All present agreed, 5-0 in favor

Site walk schedule: The Board scheduled a site walk for Monday, August 7, 2023 on the property. Legal notices to be posted on bradfordnh.org and two other locations.

Kathleen will send notices to abutters.

Motion: Jim Varney moved that the Board accept the application as complete.

Second: Nathanial Bruss

Decision: All present agreed, 5-0

Jim Hill appeared for guidance on building a house on his property on State Route 114. Since the property is in a business/residence zone, the Board agreed that building a residence should be okay. A site plan will need to be filed with the Planning Board.

Volunteer from ZBA requested to work on proposed Shoreland Protection District sub-committee

Jim Varney has volunteered.
