Planning Board Minutes 09.29.22

Site Walk: Lot Line Adjustment Map 02, Lots 80 and 81; Marshall Hill Rd, Bradford.
Meeting started at 6:16pm.

Site Walk started at 6:16pm.


The group walked the new lot line. At one end of the new line is a granite post and at the other a metal pin. The group was satisfied with the plan shown and did not see any outstanding items.

The Site Walk ended at 6:27pm.

The public meeting was called to order at 7:03 on Thursday, September 29th, 2022.

Public Hearing: 105 and 109 Marshall Hill Rd, Bradford NH (Map 2/Lot 80 & 81).

The Public Hearing was opened at 7:03pm. Vice Chair Troy read the Public Hearing rules and procedures into record. Public Notice was noticed by certified mail, online and posted in two public places.

Mr. Matt Monahan from the Central NH Regional Planning Commission said they researched findings of facts in the new lot. It used to state that if Planning Board was denying an application, they would notify NHMA on specifics of the zoning regulations. Now, if the Board approves this application, they must provide specifics to NHMA showing zoning regulations were met. He will include the approval in the Notice of Decision.

Mr. Joe DiBernardo, the land surveyor, represented the applicant. Mr. DiBernardo said currently Map 2, Lot 80 has acquired frontage on Marshall Hill Rd on the southside of the property. They plan to combine Parcel 80 with Parcel 81, making it 4.75 acres. The rear lot will be reduced from a 10.4-acre parcel to an 8.25-acre parcel. Mr. DiBernardo explained the backlot provision which would allow the applicant to have a 50 foot right of way, but it has to be as long as the frontage requirement to be deemed acceptable. It must also be 1.5 times the minimum lot area. The lot would have to be 5-acres in order to be acceptable as a rear lot. There will be a utility easement reserved on lot 80 because their transformer is located on the parcel and the power line goes onto lot 81. Mr. Monahan reached out to DES about the 5-acre permit requirement. DES said relative to this proposal, the project had a previous state subdivision approval completed. Within 30-days, Mr. DiBernardo must send DES a copy of the plan for their file and write a note stating the dimension of the lot increase. No further action needs to be taken.

Mr. Doug Troy asked where the well was located on lot 81. It has not been located. Carey Rodd, the applicant said it was behind the garage according to when the house was built. Mr. DiBernardo said the well was not presented in the plan. Discussion ensued. Mr. Monahan said the well radius was not a requirement. The well is within the lot and not near the road or abutting lot.

Ms. Colburn asked if new pins were set that would designate how the lot is now configured. Vice Chair Troy said some members did a site walk. They saw the new line and the pins of the granite posts at one end and metal pins at the other end. No concerns were observed by the Board.

Mr. Monahan provided his summary of the Lot Line Adjustment for the Board to consider. He also recommended the project had no regional impact.

Vice Chair Troy read the Subdivision Application for Map 2, Lots 80 and 81, Rodd’s Boundary Line Adjustment. The Board discussed the completeness of the application.

Chair Bruss motioned to approve accepting the Subdivision Application as complete for Map 2, Lots 80 & 81. Seconded by Ms. Meise. All ayes.

Ms. Colburn motioned to approve there is no regional impact associated with the project. Seconded by Ms. Meise. All ayes.

Vice Chair Troy opened the hearing to public comment at 7:33pm. No public comment.

Ms. Meise motioned to approve the proposed Lot Line Adjustment as complete with the Bradford  Subdivision Regulations and Zoning Ordinances, specifically the rear lot requirements of the Zoning Ordinance. Furthermore, the Board approves it conditionally with the following conditions: deed descriptions signed for each lot line within 30-days, professional stamps, and signatures and Notice of Decision to be recorded at the Merrimack County Register of Deeds. Seconded by Mr. Troy. All ayes.

Vice Chair Troy closed the public hearing at 7:41pm.

Ms. Meise motioned to adjourn. Seconded by Mr. Troy. All ayes.
