TOWN OF BRADFORD

ZONING BOARD OF ADJUSTMENT MEETING

JULY 3, 2013

7:00PM

Call to Order and Roll Call:

Brooks McCandlish, Chair called the meeting to order at 7:15pm with George Cilley, Andrew Pinard and Marge Cilley Secretary present. 7:24pm Denise Renk arrived and the meeting was re-opened.

Also present were Erich Caron, Mark Fournier and Walter Royal, Building Inspector.

Motion was made to appoint Erich Caron as a Zoning Board of Adjustment member by George Cilley. Denise Renk seconded the motion. Motion carried 4-0

Motion was made by George Cilley to approve the June 5, 2013 minutes as presented.

Denise Renk seconded. Andrew Pinard abstained. Motion carried 3-0.

Public Hearing – Jim Bibbo-Deer Valley Road-Variance –Map 8, Lot 12:

Brooks McCandlish opened the Public Hearing and Jim Bibbo explained this is actually a re-application, as he was granted the variance previously, however, did not act on it within the time frame, therefore is back again. Jim went over the five conditions for the Variance to be met, reading reasons to the Board and Public. The comments were read from the Department Heads that returned the form. At this time Brooks opened the Public Hearing to the public for any questions or comments. After considerable discussion, Brooks McCandlish closed the Public Hearing and deliberation was delayed until all the other residents had been heard that were scheduled for this time.

Public Hearing-Federico Montanari-37 High Street-Variance to build a garage:

Map 16, Lot 16:

Brooks McCandlish opened the Public Hearing. Mr. Montanari presented a Shoreline Protection form to the Board. This will be a one and a half car garage. The Application was accepted as complete at the June 5th Zoning Board meeting. Federico Montanari read the five conditions for the Variance to be met. Brooks McCandlish read the Department Head replies that were returned and closed the Public Hearing. Much discussion took place.

Motion was made by Erich Caron to close the Public Hearing. George Cilley seconded. Motion carried 4-0. Deliberation was delayed until the last resident has been heard.

Public Hearing-Brad Morrow-57 Crittenden Road-Special Exception-Map 18, Lot 28:

Brooks McCandlish opened the Public Hearing and acknowledged a Shoreland Permit Apllication was received. Mr. Morrow introduced his wife, Kelly Morrow. Mr. Morrow read the 5 Criteria for Special Exception provision and commented on same. Brooks McCandlish, Chair read comments from the Departments that responded. Brooks McCandlish, Chair asked for questions or comments from the floor. Mr. Morrow stated he had spoken with the Building Inspector who referred him to the Zoning Board of Adjustment.

Michael Seraika, Beaver Brook Environmental Constutants, representing Mr. Morrow arrived at the meeting at this time.

Motion was made by Andrew Pinard to close the Public Hearing. George Cilley seconded. Motion carried 4-0.

Jim Bibbo, Public Hearing-Variance-Map 8, Lot 12

Motion was made by Erich Caron to approve the Variance as presented by Jim Bibbo having met all five of the Criteria with no conditions to be met. Seconded by George Cilley. Motion carried 4-0.

Brooks McCandlish, Chair advised there could be a re-hearing in 30 days from today’s date.

Federico Montanari-37 High Street-Variance – Garage-Map 16, Lot 16:

Motion was made by Erich Caron to approve the Variance as presented by Mr. Montanari as complete, with the condition that the footage from the center of the road showing as 25 feet or more. Seconded by George Cilley. Andrew voted No, Denise Renk voted Yes, George Cilley voted Yes, Brooks McCandlish voted Yes. Motion carried 3-1 with condition.

Brad Morrow-57 Crittendon Road-Special Exception-Map 18, Lot 28:

Motion was made by Andrew Pinard to approve the Application for Special Exception for Brad Morrow as being complete with no Conditions to be met. Seconded by Erich Caron. Motion carried 4-0.

Any Other Business to come before the Board:

Andrew Pinard handed out updated Special Exception and Variance forms for the members to peruse and make suggestions.

It was stated that the Building Permit is being updated by Walter Royal, Building Inspector. Andrew Pinard will also update the Rules of Procedure.

Alternate Appointed:

Motion was made by Andrew Pinard to appoint Mark Fournier as an Alternate to the Zoning Board of Adjustment. George Cilley seconded. Motion carried 4-0.

Motion was made and seconded to adjourn at 10:09pm
